The hold is the visible problem. The stall is the expensive one — every day without a working checkout burns the ad spend that produced the traffic anyway. But the risk nobody warns you about is the third one: your account has now been through a risk review, and it keeps that record. A new processor changes who settles your money. It does not change what Shopify knows about your store, and the terms let Shopify act again at any time on notice. Assume this is step one of two, and get a copy of everything out while you can still log in.

Why it happened — specifically for smoking accessories

Shopify Payments is underwritten by Stripe, and Stripe's restricted-businesses policy covers tobacco accessories and paraphernalia. The primary trigger is intended use: a glass piece marketed as a bong for cannabis is treated differently from one sold as a tobacco water pipe, and US federal paraphernalia law and state law both turn on the words you use and the states you ship to. The secondary trigger is product copy — language that suggests non-tobacco use moves the item from restricted to prohibited, and reviewers read your descriptions, your category names and your tag lines as evidence of intent.

Rule out the easy fix first — then deal with the real one

Rule this out first: Shopify does not publish a documented route for smoke shops. The common first move is to contact Shopify support and ask for the hemp attestation or a similar process—it does not exist for this category. What actually happens is that some merchants apply for Shopify Payments case-by-case and are declined, then move to a high-risk acquirer. The gateways these acquirers use integrate into Shopify, so the setup is straightforward, but the underwriting is separate and stricter than Shopify's own. You will be asked for product photos, compliance certifications where applicable, state licences, shipping records and proof that your copy matches paraphernalia law. Most declines happen because the merchant has already built product descriptions that describe drug use, and rewriting them after a decline signals either ignorance or evasion.

It only helps if all of these are true:

  • Your product descriptions must not reference or imply cannabis, drugs or illicit use.
  • You must ship only to states where paraphernalia sales to adults are lawful.
  • You cannot use language like 'bong', 'dab rig' or 'water pipe for cannabis' anywhere on your store.
  • You must hold tobacco-only certifications or proof of adult-only customer base from prior sales.

What this means for a business like yours

🔞 Requires age verification, and shipping is regulated in its own right

Age-restricted categories get declined on process, not product. The underwriter's question is not whether your goods are legal, it is whether you can prove a minor cannot buy them and that you are meeting the shipping regime that applies — carrier restrictions, adult-signature delivery, state registration and remittance where required. A real age gate, a compliant carrier arrangement, and evidence you geo-block the jurisdictions that ban you will change the outcome of the next application far more than any appeal to this one.

A large catalog does not affect the underwriting decision much, but it dominates everything that happens afterwards. This is the hardest category to get underwritten, and the reason is not your business — it is that the rules themselves are moving. Processors price legislative risk, not just chargeback risk, because a statutory change can make a compliant merchant non-compliant overnight and leave the acquirer holding the liability. Expect the largest reserves in the high-risk market, expect to re-document compliance more often than other merchants, and build the business so that a rule change in one jurisdiction costs you that jurisdiction rather than your whole company.

What you actually have to fix

Underwriters do not change their minds because you asked. They change them because the facts changed. For smoking accessories, these are the facts that move the decision:

Rewrite every product description for lawful paraphernalia intent only

This is the single highest-yield fix. If your copy says or implies cannabis use, recreational or otherwise, you will be declined. Rename 'bongs' to 'water pipes', remove any reference to THC, hemp, cannabis or illicit drugs, and describe the product as tobacco paraphernalia only. Audit your category names, tags, email marketing, your blog and any product reviews you display—reviewers read everything. This is not hiding; it is accurate legal categorisation. Federal paraphernalia law and state law both turn on intended use, and your copy is the only evidence.

Obtain and file a tobacco sales registration or state paraphernalia licence

Most acquiring banks will ask for proof that you are legally entitled to sell in the states you operate. This may be a tobacco licence, a paraphernalia-specific registration or a general business permit with age-restricted endorsement—the exact name and requirement varies by state. If you do not already have one, contact your state's tax authority or regulator. Many merchants skip this step thinking it is optional; underwriters treat the absence of it as a red flag for unlicensed operation.

Audit your shipping destinations and block non-compliant states

Paraphernalia law is state-specific. Some states forbid all paraphernalia sales; others permit them with age verification; others do not regulate them at all. You must know which states you can legally serve and set up your checkout to block orders to the rest. Document which states you do and do not ship to, and be ready to explain why. If you ship to a state where you have no right to sell, the acquiring bank will decline you regardless of your product copy.

Compile your sales and compliance history with prior processor or acquirer

If you have prior processing history, request a chargeback report and transaction records showing volume, average order value and dispute rates. If you have operated under a prior acquirer, ask for a reference letter or approval summary. New merchants are higher risk in this category, so a clean track record with another processor materially improves your chances. If you have no history, be clear about it; making one up will fail the background check.

The recovery playbook

  1. Work out which layer actually said noThere are three, and they have completely different consequences. If Shopify Payments declined you, your store is still open and you need a different gateway. If the Shopify platform suspended you under the Acceptable Use Policy, no gateway on earth fixes that. And if a third-party gateway's acquiring bank dropped you, that is a third decision with its own appeal route. Read the notice for which entity is speaking before you spend a day fixing the wrong problem.
  2. Get a verified copy out while you still have access — todayThis is the step people skip, and it is the only one with a deadline you do not control. A payments deactivation is not the end of the process. It is the first thing that happened. Your account has now been through a risk review and it keeps that history — the flag does not leave when the gateway does. Bolting on a third-party processor changes who settles your money; it does not change what Shopify knows about your store, and Shopify's own terms let it act again at any time, on notice. Merchants report exactly that sequence constantly: payments off, trade on for a few weeks, then a second review that closes the store. And if the store closes, admin access can go with it. That is the part that turns a bad month into a dead business, because with no admin there is no API — and with no API your catalog, your order history, your consent timestamps and every metafield your theme renders from are simply gone. Not deleted; unreachable, which is the same thing. Shopify's own CSV export cannot carry metafields, metaobjects, orders or gift card codes, so "I'll just export it" is not the plan you think it is. Take a full, verified copy into a store you control now, while you can still log in. If you recover, you have lost nothing but the price of a migration. If you do not, you still have the business.
  3. Fix the thing that triggered itUnderwriters do not reverse a decision because you asked nicely; they reverse it because the facts changed. That usually means product labelling and claims, an age or geography gate you were not running, a clearer billing descriptor, published shipping and refund terms, or evidence of fulfilment for the orders that generated disputes. Unglamorous, and the step that decides whether the next processor keeps you — because whatever tripped the first review will trip the second one too.
  4. Get underwritten somewhere that wants your categoryHigh-risk acquiring is an entire industry that exists precisely for businesses Stripe declines. You apply as what you are, disclose the termination, and expect worse terms than a low-risk merchant gets — a rolling reserve, higher rates, a volume cap. Decide whether you need a new entity — honestlySometimes you genuinely do: a new legal entity is the right answer for an acquisition, a partner split, a change of jurisdiction, or separating a high-risk product line so it can never take your main brand down with it. Sometimes it is being sold to you as a way to look like a different applicant — which is a completely different thing, and is fraud. The section below is blunt about which is which.

A smoke shop's data is dangerous to move by hand for a specific reason: your age verification and product compliance metadata lives in metafields. If your store records the tobacco-licence check date, the customer age, or the state-specific compliance flag per product in metafields—and most do—a CSV export cannot carry them forward. Does this need a new company?

A new legal entity does not reset your personal history in MATCH, the Mastercard fraud database. MATCH records follow the individual—founder, owner, signatory—for five years. So forming a new company to escape a prior decline will fail the underwriting anyway, because the person behind it is the same. A new entity makes sense only if you have genuinely changed your product line or your business model, and you disclose that change to the acquirer upfront.

Frequently asked

Which gateway will process smoke shop orders?

The gateway is straightforward—Authorize.net, PaymentCloud, Corepay and Easy Pay Direct all support Shopify natively. But the merchant account behind the gateway is the hard part. You need an acquiring bank that accepts the risk category, and they underwrite independently of the gateway. Which one will take you, at what reserve and at what rate, depends on your product copy, your state registrations and your processing history. Rather than email cold, work with a high-risk broker or a nicotine-specialist ISO who has relationships already built.

Why was I declined if I sell tobacco products lawfully?

Most declines are not about legality—they are about evidence of intent. If your product copy describes cannabis use, the processor assumes you are marketing illegal drug paraphernalia, not lawful tobacco accessory. So the first step is to rewrite your descriptions as tobacco-only paraphernalia, with no reference to cannabis or THC. Second, if you have no state tobacco licence or paraphernalia registration, get one. The underwriter sees the absence as a sign you may not be operating legally.

Will my product data and compliance metadata survive a store move?

Not by default. Shopify's CSV export cannot carry metafields, so any compliance flags, age-verification records or product certification data you store in metafields will be lost in a naive migration. You will need to map those fields manually, export them separately or use a professional migration service that rebuilds your metafield structure. Gift card codes also cannot be exported, so they can only be re-issued to customers.

What reserve should I expect?

High-risk acquiring banks typically hold 10–20% of your monthly volume in a rolling reserve, held for 90–180 days. This is not punishment—it is risk management on a category with higher chargebacks and regulatory risk. The exact rate depends on your processing history, your dispute rate and the bank's appetite. Do not accept a verbal promise of a lower reserve; confirm it in writing before you process your first transaction.

Can I get Shopify Payments reinstated?

Occasionally, when the decision rested on a fact you can correct and evidence — a mislabelled product, a missing licence, an unclear descriptor, fulfilment records for disputed orders. If your product category is on the payment processor's prohibited list, no reviewer has the authority to grant an exception, and waiting for one costs you the selling window. Appeal once in writing, then start the alternative the same day.

How long does Shopify hold my money after Shopify Payments is disabled?

A standard hold against chargeback risk runs up to 120 days from the last transaction, because that is roughly how long a cardholder has to dispute one. It can run longer where Shopify suspects illegitimate commerce. The held balance is still yours and is normally released after the window; it is the loss of a working checkout, not the hold itself, that does the real financial damage.

Do I need a new Shopify store, or just a new payment gateway?

If only Shopify Payments was disabled, your store is fine — you need a third-party gateway whose acquiring bank accepts your category, and nothing has to move. You need a new store when the platform itself closed the old one, when you are separating a high-risk product line into its own entity, or when a new provider requires a clean install. Those are genuinely different situations and it is worth being sure which one you are in before you migrate anything.

Will opening a new company get me a new merchant account?

Not by itself, and this is the most important thing on this page. MATCH — the card networks' terminated-merchant file — lists the people behind a terminated business as well as the business, for five years, and every acquirer screens it. A new company with the same beneficial owner does not present as a new applicant. A new entity is the right answer for real structural reasons; it is not a way to look like someone else, and anyone selling it to you that way is selling you fraud.

Can you get my payments turned back on?

No, and nobody outside Shopify and its payment processor can.
