Vapes & E-Liquid Massachusetts

You cannot sell flavoured vapes or e-liquid into Massachusetts.

Massachusetts prohibits the sale of a nicotine product with a distinguishable taste or aroma other than tobacco. That includes menthol. This is not a shipping restriction — it is a categorical ban on the product itself in that state. You cannot sell most of your vape and e-liquid catalog there at all. A flavour ban removes revenue more severely than any shipping rule, because it cuts your inventory, not just your geography. This page covers what the ban means for your orders, how to control what ships where, and why an acquirer flags a store that ships into Massachusetts when it should not.

Cannot be sold here · Massachusetts

Massachusetts operates a full flavour ban, commonly including menthol — the sale of a nicotine product with a distinguishable taste or aroma other than tobacco is prohibited.

A flavour ban removes most of a vape catalog rather than restricting how it ships, which is why it hits revenue harder than any shipping rule on this site.

What this means for your store

If you have shipped flavoured vapes or e-liquid into Massachusetts, you have sold prohibited products in that state. New orders from Massachusetts must be refused at checkout unless your entire inventory is unflavoured tobacco-only — which, for most merchants, it is not. Existing customers in Massachusetts cannot receive refills or replacements of flavoured products. If you continue to ship there, you are knowingly selling contraband, and a chargeback or refund dispute will surface it in your processor's compliance review. A single Massachusetts order shipped in error can trigger account review. The cost of getting this wrong is not a fine to the state — it is your payment processing account.

The control that actually enforces it

In Shopify, the standard control is a shipping profile that blocks Massachusetts for flavoured SKUs. You assign that profile to each flavoured product, and Shopify prevents checkout to that state. Without it, a customer in Massachusetts can place an order; the only brake is a manual catch at fulfillment. That is not a control — that is hope. If you have a small unflavoured line, you can tag those products and set a market that ships only to Massachusetts, but most stores need the inverse: a rule that says

Why an underwriter cares

A high-risk underwriter sees Massachusetts shipments as proof you are not screening orders by state law. Shipping a prohibited product is independent of the product risk itself — it is evidence of broken order controls. An acquirer wants to see a Shopify shipping profile or equivalent that prevents checkout to Massachusetts for your flavoured range. If you cannot show that control, the processor assumes you are shipping contraband by accident (negligence) or intention (fraud), neither of which they will underwrite. Documentary evidence of the block — a screenshot of your Shopify rules, or a test checkout that fails — is what moves you from

Frequently asked

Can I sell any vapes or e-liquid into Massachusetts?

Only unflavoured tobacco-flavoured nicotine products. If your entire inventory is tobacco-only with no distinguishable taste or aroma, you may sell it there. For most vape merchants, that is zero SKUs. If you have a small unflavoured line, you can sell that line to Massachusetts and block the rest.

What happens if I have already shipped flavoured vapes to Massachusetts?

You have sold a prohibited product in that state. Each order is a compliance breach independent of whether you were aware. Going forward, refuse all orders from Massachusetts for flavoured products at checkout. If a customer disputes a charge or requests a refund, disclose the shipment to your processor proactively — do not wait for them to find it in a chargeback.

How do I set up the block in Shopify?

Assign a shipping profile to each flavoured product that excludes Massachusetts. Test it by attempting checkout from a Massachusetts address; the cart must show 'shipping not available' or equivalent. Do not rely on a note in your fulfillment system or a manual review step. A Shopify shipping profile is a control; everything else is a process that fails.

Play it straightA migration moves your data — it is not a way around a platform or processor rule, and it will not get a decision reversed. You remain responsible for fixing whatever triggered the review, for telling a new processor the truth about your business and your history, and for complying with Shopify's Terms of Service and your new provider's rules. What we make certain of is narrower and more useful: that when you do have somewhere to sell, none of your catalog, customers, order history, content or SEO got lost getting there.
